These Terms of Service (“Terms”) govern your access to and use of the Tuscan Imports website (the “Site”) and the purchase of products from Tuscan Imports (“Tuscan Imports,” “we,” “us,” or “our”). By visiting the Site, browsing, or placing an order, you agree to be bound by these Terms and our related policies, including our Privacy Policy, Shipping Policy, and Refund Policy (together, the “Policies”), which are incorporated by reference.

If you do not agree to these Terms, do not use the Site or purchase products from us.

Use of the Site and Customer Accounts

Eligibility. You must be at least the age of majority in your jurisdiction to use this Site. By using the Site, you represent that you are legally able to enter into a binding agreement.

Accounts. You may be able to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and current information and to update it as necessary.

Acceptable use. You agree not to:

Orders, Pricing, Payments, and Promotions

Product information. We strive to display product descriptions, features, specifications, and colors accurately. However, we do not guarantee that product descriptions or other content on the Site are complete, reliable, current, or error-free. Colors may vary due to device display settings and lighting.

Pricing. Prices are shown in [USD] unless stated otherwise. Prices, promotions, and availability are subject to change without notice. We may correct pricing errors (even after an order is submitted). If the correct price is higher than stated, we may contact you for instructions before shipping or cancel the order and notify you.

An order is not considered accepted until we process payment and confirm the order and/or ship the item(s).

Payment. You agree to provide valid payment information and authorize us (and our payment processors) to charge your payment method for:

• Any other charges disclosed at checkout.

Taxes. Sales tax (and other applicable taxes/duties) may be added at checkout based on your shipping address and applicable law. You are responsible for any duties, customs fees, or import taxes imposed by your jurisdiction unless we explicitly state otherwise.

Promotions and discount codes. Promotions and codes are subject to stated terms (expiration dates, exclusions, minimum purchase amounts, and one-time use limits). Unless required by law, promotions cannot be retroactively applied to previous purchases.

Shipping, Delivery, Returns, and Risk of Loss

Shipping and delivery. Shipping options, costs, and estimated delivery windows are shown at checkout or in our Shipping Policy. Delivery dates are estimates and not guaranteed. We are not responsible for delays caused by carriers, weather, customs, or events outside our reasonable control.

Shipping address accuracy. You are responsible for providing a complete and accurate shipping address. If an order is returned due to an incorrect or incomplete address, we may charge additional shipping fees to reship the order.

Risk of loss and title. Risk of loss transfers to you when the package is delivered to the carrier (unless otherwise required by applicable law). Title transfers upon delivery to the carrier or upon delivery to you, depending on your jurisdiction.

Returns and refunds. Returns, refunds, exchanges, and eligibility rules are governed by our Refund Policy. Please review that policy carefully before purchasing. If there is any conflict between these Terms and our Refund Policy regarding returns/refunds, the Refund Policy controls.

Damaged or incorrect items. If your order arrives damaged, defective, or incorrect, contact us within [e.g., 7] days of delivery with photos of the item and packaging so we can evaluate and assist.

Intellectual Property, Content, and Third-Party Links

You represent that you own or have permission to submit the User Content and that it does not infringe third-party rights.

Third-party services and links. The Site may include links to third-party websites or services. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

Disclaimers, Limitation of Liability, Indemnification, and Legal Terms

Disclaimer of warranties. To the maximum extent permitted by law, the Site, products, and services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers, so these disclaimers may not fully apply to you.

Limitation of liability. To the maximum extent permitted by law, Tuscan Imports will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or business interruption, arising out of or related to your use of the Site or purchase/use of products. In no event will Tuscan Imports’ total liability exceed the amount you paid us for the product(s) giving rise to the claim.

Indemnification. You agree to defend, indemnify, and hold harmless Tuscan Imports and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

Changes to these Terms. We may update these Terms from time to time. The “Effective date” above indicates when these Terms were last updated. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.
